01About these terms

These Terms of Service ("Terms") govern your use of the FOWS website at fows.ai, the FOWS application at app.fows.ai, and all related AI agents, tools, and services (together, the "Service"). The Service is provided by FOWS AI ("FOWS", "we", "us", or "our").

By creating an account, starting a free trial, requesting early access, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business or client, you confirm you have authority to bind them, and "you" includes that business.

If you do not agree to these Terms, do not use the Service.

02AI and third-party services

FOWS is an agentic platform. It uses artificial intelligence and large language models ("AI") to build websites, write content, optimise pages for search and answer engines, manage listings, reply to enquiries, and perform other tasks on your behalf.

To provide the Service we rely on third-party providers, including cloud infrastructure, AI model providers, databases, content delivery, payments through Stripe, and email. These may include:

This list shows the main providers we rely on today. Providers change as the service grows, and we may add, replace, or remove them. Each processes data under its own terms and privacy policy.

By using FOWS, you acknowledge and consent to:

• your content, prompts, website data, and related information being sent to and processed by AI models and third-party services to provide the Service;
• data being processed and stored in other countries where our providers operate; and
• each third-party provider processing data under its own terms and policies, in addition to ours.

We choose providers and settings intended to limit their use of your data to delivering the Service, but we do not control third-party providers and are not responsible for their acts, omissions, outages, or changes to their services.

03AI-generated content and agent actions

AI can make mistakes. Content, recommendations, rankings insights, and messages produced by FOWS agents may be inaccurate, incomplete, out of date, or unsuitable for your purposes. You are responsible for:

• reviewing content before it is published, or accepting the risk if you enable automatic publishing;
• making sure published content, claims, prices, and messages are accurate and lawful for your business and location;
• the actions you authorise agents to take, including emails, replies to reviews, and messages sent to your leads and customers.

FOWS does not guarantee any search engine ranking, AI assistant recommendation, citation, traffic level, lead volume, or business result. Search engines and AI providers control how their systems rank and cite sources.

04Changes to AI models and agents

AI is changing quickly, and so is FOWS. To keep improving the Service, we may at any time and without notice:

• add new AI models, or change or remove existing ones;
• switch the AI provider or model that a particular agent uses;
• update how agents work, including their instructions, settings, and the tasks they perform; and
• test new models and agent behaviour with some or all users before releasing them more widely.

We work hard to test changes and prevent problems, but a new or updated model or agent may sometimes behave differently from before or produce results that are not intended, such as content that is off-brand, inaccurate, incomplete, or published or sent unexpectedly.

If you see or feel that any agent is not working as intended, please contact support as early as possible at hello@fows.ai, and pause the agent or trigger in your dashboard if you can. Reporting issues quickly helps us fix them and limits any impact on your website, customers, or connected accounts. To the extent permitted by law, we are not responsible for loss caused by an agent behaving unexpectedly where you did not report it promptly or kept it running after becoming aware of the problem.

05Your account

You must be at least 18 years old and able to form a binding contract to use the Service. You must give accurate information, keep your login details secure, and tell us promptly at legal@fows.ai if you suspect unauthorised access. You are responsible for all activity under your account, including by team members you invite.

06Plans, credits, trials, and billing

Plans and credits. Paid plans include a set number of websites and a monthly allowance of credits that agents use as they work. Unused credits do not roll over unless we say otherwise. Some specialist agents and features may be charged as add-ons on top of your plan. You will see the cost before you switch on a paid add-on.

Free trials. Free trials include a limited number of trial credits and last for the period shown when you sign up. Unless you cancel before the trial ends, your subscription will begin and you will be charged for the plan you selected.

Billing. Subscriptions renew automatically each month or year, depending on the billing period you choose, until cancelled. Payments are processed by Stripe, our payment merchant. You authorise us and Stripe to charge your payment method for fees, add-ons, and applicable taxes. Prices are shown in US dollars unless stated otherwise.

Introductory pricing. Current prices are introductory. We may change prices, plans, credit allowances, or add-on charges. We will give you reasonable notice before a price change affects your subscription, and you may cancel before it takes effect.

Cancellation. You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.

No refunds. To the extent permitted by law, all fees, subscriptions, and add-on charges are non-refundable, including for partial billing periods, unused websites, and unused credits.

07Credits, AI results, and reimbursement

Used credits are final. Credits are consumed when an agent or AI model performs work, whether or not you use, publish, or are satisfied with the result. Credits that have been used are gone and cannot be restored, retrieved, transferred, or exchanged for cash.

AI results vary. AI models do not always produce the result you are looking for. Output depends heavily on the instructions, prompts, and information you provide, and getting the result you want may take several attempts, clearer prompts, or more detail. Because each attempt uses real processing from our AI providers, we may not be able to reissue or reimburse credits when a model does not produce the result you expected. In those cases you may need to reprompt, refine your instructions, or provide better information.

Genuine faults. If credits are consumed because of a clear technical fault on our side, such as a failed job that produced no output at all, contact legal@fows.ai. We will review it and decide, at our discretion, whether to restore any credits.

Service provided as is. The Service, including all AI output and agent actions, is provided "as is" and "as available", without any promise that it will meet your specific requirements or expectations, to the extent permitted by law.

08Acceptable use

You must not use the Service, or direct any agent, to:

• break any law, including privacy, consumer, anti-spam, advertising, and intellectual property laws;
• send unsolicited commercial messages, or contact people without the consent required by laws such as the Spam Act 2003 (Cth), CAN-SPAM, or GDPR;
• create misleading, deceptive, defamatory, hateful, or harmful content, or fake reviews or listings;
• impersonate any person or business, or misrepresent your affiliation;
• infringe anyone's rights, or upload content you do not have the right to use;
• attempt to disrupt, overload, reverse engineer, scrape, or gain unauthorised access to the Service or its providers;
• use the Service to build a competing product, or to generate content that breaches the usage policies of our AI providers.

We may suspend or remove content, agents, or accounts that we reasonably believe breach these Terms.

09Proper use of AI agents and models

FOWS agents and the AI models behind them are provided to build, run, and grow your website and online presence. You must only use them for that purpose. You must not use or abuse the AI agents or models for anything else, including:

• using agents or models as a general-purpose chatbot or AI tool for tasks unrelated to your FOWS websites and business;
• trying to bypass, disable, or manipulate their safeguards, instructions, or limits, including through jailbreaks or prompt injection;
• attempting to extract system prompts, model behaviour, training data, or other confidential information about the Service or our providers;
• running automated, excessive, or artificial workloads designed to consume resources rather than to do genuine work;
• reselling, sharing, or giving others access to the agents or models outside the features FOWS provides; or
• generating content that breaches these Terms, the law, or the usage policies of our AI providers.

We may monitor usage to protect the Service, and we may limit, suspend, or terminate access, and forfeit any credits used, if we reasonably believe agents or models are being misused.

10Connected accounts and social media platforms

You may connect third-party accounts such as Google Business Profile, email, calendars, CRMs, and social media platforms. When you do, you authorise FOWS to access and act on those accounts within the permissions you grant.

Your use of any connected platform, including Google, Meta (Facebook and Instagram), LinkedIn, X, TikTok, and YouTube, remains subject to that platform's own terms, policies, and community guidelines, and FOWS will operate within them. Platforms may limit, change, or withdraw access at any time, which may affect features that depend on them. You can disconnect an account at any time from your settings.

FOWS's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.

11Scheduled posting with agentic triggers

Some agentic triggers can create, schedule, and publish posts for you, for example on social media accounts or your Google Business Profile. If you use agentic triggers for scheduled social media or Google Business Profile posting, you:

• consent to FOWS connecting to the relevant services, such as Google, Meta (Facebook and Instagram), LinkedIn, X, or other platforms you choose;
• authorise FOWS agents to access your connected accounts and to create, schedule, edit, publish, and manage posts on your behalf, within the permissions you grant;
• confirm you own or are authorised to manage those accounts and to post on behalf of the business; and
• remain responsible for what is posted, including making sure it is accurate, lawful, and compliant with each platform's policies.

Posting depends on each platform's systems and rules. A platform may reject, delay, remove, or limit posts, or restrict access, and FOWS is not responsible for those decisions. You can review scheduled posts, turn triggers off, and disconnect any account at any time, which stops future posting from FOWS.

12Your content and intellectual property

Your content. You keep ownership of the content and data you provide and the websites and content created for you ("Your Content"), subject to any rights of third parties. You give FOWS a worldwide, non-exclusive licence to host, copy, process, adapt, and display Your Content only as needed to provide, secure, and improve the Service, including by sending it to AI and third-party providers.

AI output. Because AI output can be similar for different users, we cannot promise that AI-generated content is unique or free of third-party rights. You are responsible for checking content before relying on it commercially.

Our platform. FOWS, including its software, design, agents, branding, and documentation, is owned by us or our licensors. These Terms do not give you any rights in it beyond using the Service as permitted.

Feedback. If you send us suggestions, we may use them without obligation to you.

13Perks marketplace

The Perks marketplace lets businesses buy services from FOWS and from independent sellers such as agencies and specialists. When you buy from an independent seller, the service contract is between you and that seller, and the seller is responsible for delivering it. FOWS facilitates listings, payment, and delivery, and may charge sellers a platform fee disclosed when they list. Sellers must comply with these Terms and any seller terms we publish.

14Availability and changes to the Service

We work to keep the Service available and secure, but it is provided on an "as is" and "as available" basis and may be interrupted by maintenance, provider outages, or events outside our control. We may add, change, or remove features, agents, triggers, integrations, and providers at any time. Early access and beta features may be less reliable.

15Limitation of liability

To the maximum extent permitted by law:

• we exclude all implied warranties, including about accuracy of AI output, search or AI rankings, and fitness for a particular purpose;
• we are not liable for indirect or consequential loss, or for loss of profit, revenue, data, goodwill, or opportunity;
• we are not liable for the acts, omissions, or failures of third-party providers or connected platforms; and
• our total liability in connection with the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

16No liability for harmful code

FOWS takes reasonable precautions to ensure that its services, including websites, hosting environments, and any related digital assets, are free from harmful code or cyber threats. However, FOWS does not guarantee that the website or services provided will be completely free of harmful code such as viruses, malware, spyware, or adware, nor can it ensure that third-party software (such as plugins or platforms) used in connection with the Service is free from vulnerabilities.

You acknowledge and accept that you provide your personal information and digital assets at your own risk.

Harmful Code is defined as any form of harmful surreptitious code or contaminants, including but not limited to misinformation, viruses, bugs, Trojan horses, spyware, or adware.

To the extent permitted by law, FOWS is not liable for any loss or damage caused by Harmful Code.

17Indemnity

To the extent permitted by law, you agree to indemnify FOWS against claims, losses, and costs arising from Your Content, your breach of these Terms or the law, or actions taken by agents at your direction, except to the extent caused by our own breach or negligence.

18Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, create risk or legal exposure for us or others, or if we stop offering the Service. Where reasonable, we will give notice and a chance to export Your Content. After termination we may delete Your Content in line with our Privacy Policy.

19Changes to these Terms

We may update these Terms. If a change is material, we will notify you by email or in the app before it takes effect. Continuing to use the Service after changes take effect means you accept them. If any part of these Terms is unenforceable, the rest continues to apply.
